PROCEDURES
Pre-Contract Procedures
A. Buyer completes the Request for Order (LOI) in the format provided by the seller , signs the NDA and provides a Bank Letter of Readiness signed by two bank officers. Buyer returns these documents directly to Supplier.
B. Seller verifies banking facility and issues draft contract.
Contract Procedures for FOB delivery
1.1. Buyer and Seller sign and execute contract by lodging with their respective banks.
1.2. Bankers set the custodial hold for one month's purchase assurance via MT799 to be confirmed in screen or sent by SWIFT. Buyer also has the option to place a cash backed SBLC, blocked funds MT760 or payment vs. delivery MT543, or MT103/23 (if available). Seller’s Banker immediately confirms POP and POF SWIFT via bank to bank phone call.
1.3. Seller issues Commercial Invoice, and POP will be programmed into Buyer’s name issued by the Seller's bank via MT799 as Tank farm receipts, SGS report on Quality and Quantity and Authorization to perform a Dip Test. Seller coordinates lift to Buyer's logistics.
1.4. Buyer verifies Tank farm receipts, SGS report on Quality and Quantity, and perform a Dip Test.
1.5. Upon successful dip test, the Buyer transfers payment for Commercial Invoice via SWIFT MT 103 or TT wire all within 24 hours and Title passes to Buyer.
1.6. Buyer Transfers fuel to their tanks or vessels and transaction is deemed completed.
Once a Principal Buyer is identified and the procedures agreed upon it is the privilege of the Blackman International Group to make an introduction to the Supplier’s CEO and Supplier’s Transaction Manager, and to recommend the Principal Buyer receive the Offer & Advice directly from the Supplier’s company, executed by the CEO.

(Pre-contract procedures)
A. Principal Buyer(s) holds conference call direct with CEO and the Transaction Manager of the Supplier’s Company.
B. CEO of Supplier’s company issues executed documents on company letterhead. These documents include a Request for Order (LOI or ICPO) Template, Procedure List, Approved Language for Banking, and a NDA.
C. Buyer completes the Request for Order (LOI or ICPO) in the format provided by the Seller, signs the NDA and provides a Statement of Readiness Letter signed by two bank officers on Bank Letterhead.
Statement of Readiness Letter ONLY asks the following questions:
1. Is the Buyer in good standing with the Bank?
2. Upon execution of our contract, will the Buyer have the capability to purchase?
D. Buyer returns these documents direct to Supplier with the Request for Order.
E. Seller’s bank verifies banking facility and issues draft contract.
(Contract procedures)
Seller issues draft contract in the Buyers name.
1.1. Buyer and Seller sign and execute contract by lodging with their respective banks. The SPOT has a bilateral penalty of 20% of the total value of the contract for non-performance.
1.2. Bankers set the custodial hold for one month's purchase assurance via MT799 to be confirmed in screen or sent by SWIFT. Buyer also has the option to place a cash backed SBLC, blocked funds MT760 or payment vs. delivery MT543, or MT103/23 (if available).
1.3. Seller will issue Commercial Invoice, and POP will be programmed into Buyer’s name issued by the Seller's bank via MT799 as Tank farm receipts, SGS report on Quality and Quantity and Authorization to perform a Dip Test. Seller coordinates lift to Buyer's logistics.

[13:22:57] СВЕТА: Transaction Manager, and to recommend the Principal Buyer receive the Offer & Advice directly from the Supplier’s company, executed by the CEO.
The following further describes the procedures in paragraph form. This is for edification purposes only and the actual 6 point procedure list (listed above) is the ruling procedures.
Above are the initial FOB Rotterdam SPOT JP54 purchase procedures. In order to better serve your needs and have a complete understanding of your request, the Supplier requires the Buyer to submit a Request for Order (LOI or ICPO with verifiable banking) so there will be no confusion or misunderstandings. Supplier only offers JP54 for sale to Principal Buyers under a bank to bank SWIFT guaranteed format. The Supplier requires the Buyer to arrange bank guaranteed payment for the purchase amount from an approved world bank via instituted Custodial Hold via blocked funds MT799. Your banker retains custodianship of your funds throughout the life of the contract. Clients may also post a payment vs. delivery SWIFT MT 543, or blocked funds MT 760, or by cash backed SBLC to provide financial assurance to the transaction.
Supplier purchases fuel for the Buyer's order from our refinery supplies and holds title to the fuel for the FOB sale. As Title Holders we will not accept SWIFT MT199, non-blocked MT799 or MT999 as these are not committed blocked funds guaranteed by SWIFT for the purchase. Supplier requires cash backed bank instruments and will not accept any leased or rented financial banking instruments or credit lines that require POP up front to access purchase funds.
Supplier offers the Principal Buyer a SPOT purchase into Term Contract (Rolling SPOT contracts are available) with a minimum purchase order of 2,000,000 BBLS. The discount is currently NWE PLATT minus 10%, FOB Rotterdam for this minimum order. For orders of 10,000,000 BBLS the discount increases to 15% off NWE PLATT. This price is subject to change until the contract is issued, returned signed and received.
Please review the transaction requirements and procedures and confirm you are in agreement with our procedures as they are non-negotiable. We respectfully request you submit an LOI or ICPO direct to Supplier’s company to proceed, this will confirm our procedures, your banking, and the purchase amount for the initial SPOT transaction.
We insist the LOI or ICPO include verifiable banking from an acceptable world bank. The Buyer's trade banker contact information should be listed to assist the Buyer in the closing and arrangements should be made with the bank to issue a SWIFT POF guarantee prior to signing the issued SPOT purchase contract. Upon approved banking, a draft contract will be issued in the name of the Buyer with his approved banking information.
Once the draft contract terms are agreed, the contract initialed, signed and sealed, exchanged and lodged at respective banks, the Seller’s bank will immediately initiate the bank–to-bank call to your banker. In this call Seller banker will ask for a confirmation of
[13:23:20] СВЕТА: POF and will confirm that he is holding POP for the Buyer. The bankers then work out the details for the Custodial Hold and the issue of the SWIFT MT799 POF and MT799 POP.
POP will be programmed into Buyer’s name and consist of current SGS Q & Q report, Tank farm receipts and the authorization to perform a Dip Test. Commercial Invoice will be sent to Buyer. Upon receipt of verifiable POP to the Buyer's bank, the Buyer will verify fuel and make payment within 24 hours for the Commercial Invoice amount by SWIFT MT103 or TT wire transfer and title will exchange. When the fuel delivery is documented to the Buyer’s tanks or vessel, the transaction is completed.
We understand your company is a serious Buyer but as Title Holders to fuel that we order specifically for each client, we require bank guaranteed blocked funds for all purchases. The market is fraught with problems. Our procedures take into account these problems and make it risk free to both the Buyer and Seller. We understand that not everyone will be able to comply with our procedure because of company or banking policy but our POF and POP SWIFT bank to bank procedure will not change.
